DMCA Copyright Infringement Policy

Slumbering Forest LLC ("SForest," "we," "us," or "our") respects intellectual property rights and is committed to complying with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable copyright laws. We have adopted and implemented a policy designed to:

  • Prevent the posting, uploading, transmission, or distribution of copyrighted material on our platform without proper authorization
  • Promptly respond to reports of alleged copyright infringement
  • Facilitate the removal of infringing content
  • Take appropriate action against repeat infringers

This Copyright Infringement Policy applies to SForest, including our website (https://sforest.io), mobile applications, and all associated services and content.


If you believe that your copyrighted work has been posted, uploaded, or distributed on SForest without authorization, you may submit a written copyright infringement notice to SForest's designated copyright agent. To be effective, your notice must include all of the following information:

2.1 Required Information

(a) Identification of Copyrighted Work

  • A description of the copyrighted work you claim has been infringed
  • If multiple works are involved, provide a representative list
  • Include the URL(s) or description of where the infringing material is located on SForest

(b) Identification of Infringing Material

  • A clear description of the specific location of the infringing content
  • Sufficient information to allow us to locate and identify the material
  • Direct link(s) to the infringing content (where available)

(c) Your Contact Information

  • Your full name
  • Your physical address
  • Your email address
  • Your telephone number

(d) Statement of Good Faith Belief

  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • Include the phrase: "I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner."

(e) Penalty of Perjury Statement

  • Your signature (physical or electronic)
  • The date of your submission
  • A statement made under penalty of perjury that the information you have submitted is accurate to the best of your knowledge

2.2 Submission of Notice

Please send your written copyright infringement notice to SForest's Designated Copyright Agent:

Upon Receipt: We will review your notice and, if valid, will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who uploaded or posted the content
  • Take appropriate action in accordance with the DMCA

3. Counter-Notification Procedures

If your content has been removed due to a copyright infringement claim, you may submit a counter-notification if you believe the removal was made in error or that you have the right to post the material.

3.1 Requirements for Counter-Notification

To submit a valid counter-notification, you must provide:

(a) Identification of Material

  • Your name, address, and telephone number
  • Identification of the material that was removed
  • A statement of where the material was located before removal

(b) Statement Under Penalty of Perjury

  • A statement, made under penalty of perjury, that you have a good faith belief that the material was removed by mistake or misidentification
  • The phrase: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed by mistake or misidentification."

(c) Consent to Jurisdiction

  • A statement that you consent to the jurisdiction of the Federal Court for the district where you are located (or, if you are outside the US, the US District Court for the Western District of Washington, where SForest is located)
  • An agreement that you will accept service of process from the person who provided the original copyright notice

(d) Your Signature

  • Your physical or electronic signature

3.2 Submission and Review

Submit your counter-notification to the address listed in Section 2.2 above. Upon receipt of a valid counter-notification:

  • We will provide a copy to the person who submitted the original copyright notice
  • That person will have 10 business days to notify us that they have filed suit to maintain the injunction against the material
  • If we do not receive notice of legal action within 10 business days, we will restore the material (unless we have reason to believe the material is illegal or infringing)

4. Repeat Infringer Policy

SForest takes copyright infringement seriously and maintains a repeat infringer policy designed to discourage repeated violations.

4.1 Progressive Enforcement

  • First Infringement: We will issue a warning and may remove the infringing content
  • Second Infringement: We may suspend the user's account temporarily
  • Third or Subsequent Infringement: We may permanently terminate the user's account and deny the user access to SForest's services

4.2 Determination of Repeat Infringement

  • We evaluate repeat infringement based on the number of valid DMCA notices we have received
  • We maintain records of all notices received
  • Accounts that demonstrate a pattern of intentional copyright infringement will be terminated at our sole discretion

5. DMCA Safe Harbor

SForest is designed to comply with the safe harbor provisions of 17 U.S.C. § 512 ("DMCA Safe Harbor"). As an online service provider that:

  • Does not have actual knowledge that content is infringing
  • Is not aware of facts or circumstances indicating infringing activity
  • Does not receive financial benefit directly attributable to infringing activity (where we have the right and ability to control the activity)
  • Expeditiously removes or disables access to content upon receiving a valid notice of infringement

We are entitled to protection from liability for infringement claims related to user-posted content, subject to compliance with the DMCA notice and take-down procedures outlined in this policy.


6. Cooperation with Law Enforcement

SForest cooperates with law enforcement and other government agencies in investigating copyright infringement and other crimes. We will disclose user information as required by law or when we believe, in good faith, that disclosure is necessary to:

  • Comply with legal processes
  • Enforce our Terms of Service
  • Protect the safety or rights of users or the public

7. No Obligation to Monitor

While SForest has implemented systems to help identify and remove potentially infringing content, we do not undertake continuous monitoring of user-posted content. We rely on copyright holders to notify us of alleged infringement.


8. Governing Law and Jurisdiction

This Copyright Infringement Policy is governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding relating to this policy shall be brought exclusively in the courts of Washington State or the US District Court for the Western District of Washington, and you consent to the exclusive jurisdiction and venue of these courts.


9. Modifications to This Policy

SForest reserves the right to modify this policy at any time. Changes will be effective upon posting to the website. Your continued use of SForest following the posting of changes constitutes your acceptance of the revised policy.
